Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

11. Force Majeure

Moftly is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to:

• Acts of nature (floods, earthquakes, fires)
• Internet outages or telecommunications failures
• Hosting provider or third-party service failures (e.g., Vercel, Brevo, Plausible)
• Government actions, sanctions, or regulatory changes
• Cyber attacks (DDoS, hacking attempts)
• Pandemics or public health emergencies

12. Termination

Moftly reserves the right to terminate or suspend your access to its services at any time, with or without notice, for any reason, including:

• Violation of these Terms
• Suspected fraudulent or harmful activity
• Discontinuation of services
• Legal or regulatory requirements

Upon termination, your right to use the services ceases immediately. Sections related to intellectual property, limitation of liability, and governing law survive termination.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Romania and applicable European Union law.

Any disputes arising from or related to these Terms shall first be addressed through good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the Romanian courts in Bucharest.
